Terms of Service
These terms (“Terms”) govern your use of the HookPoint iOS app and related websites (collectively, the “Service”), provided by Votique LLC, an Arkansas limited liability company (“HookPoint,” “we,” “us”). By installing or using the Service, you agree to these Terms. If you don’t agree, please don’t install or use it.
1. The plain-English version
- HookPoint is a fishing companion app. It gives you guidance, not guarantees.
- Subscriptions are sold through Apple. Apple handles your card; we don’t see it.
- Your free trial lasts 7 days. We’ll never charge you without a confirmed Apple subscription.
- Always verify fishing regulations on the official state agency site before you fish.
- Don’t use HookPoint to break the law or harm someone else’s gear, property, or person.
- If something we say in this contract conflicts with a real law that protects you, the law wins.
2. Eligibility
You must be at least 13 years old to use HookPoint. If you are under the age of majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.
3. Your account & data
HookPoint does not require you to create an account. Your catch log, photos, notes, and preferences live on your device by default, governed by our Privacy Policy.
4. Subscriptions, billing, and trials
4.1 Trial
Every new install includes a 7-day free trial with full access to all features. No payment is taken to start the trial. At the end of the trial, your selected subscription begins automatically unless you cancel before it ends.
4.2 Subscription tiers
HookPoint offers three auto-renewing subscriptions:
- Weekly — US$3.99 per week
- Monthly — US$4.99 per month
- Yearly — US$34.99 per year
Prices may vary by storefront. Apple displays the storefront-localized price before purchase.
4.3 Auto-renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Apple will charge your account at confirmation of purchase and at each renewal. You can manage and cancel subscriptions in iOS Settings › your Apple ID › Subscriptions.
4.4 Refunds
All purchases are processed by Apple, and refund requests are handled by Apple. You can request a refund at reportaproblem.apple.com. We can request a refund on your behalf as a courtesy, but the final decision rests with Apple.
5. Acceptable use
You agree not to:
- Use HookPoint to violate any law, regulation, or third-party right.
- Reverse-engineer, decompile, or attempt to extract HookPoint’s source code, beyond what is permitted by applicable law.
- Use the Service to harvest data, scrape content, or train a competing AI model without our written permission.
- Submit photos that depict illegal activity, harassment, or content that violates state or federal wildlife law.
- Misrepresent fishing rules or regulations sourced from HookPoint to other people in ways that cause them legal harm — always link them back to the official agency source.
6. Fishing-regulation disclaimer
HookPoint summarizes fishing regulations using AI. State agencies set fishing regulations. Regulations change frequently and without notice; an agency may update a season, limit, or gear rule before HookPoint refreshes its summary.
Every regulation card in the app links to the official state agency source. Before you fish, you are responsible for verifying the rules with that source. HookPoint is a planning tool, not a legal authority.
7. AI-generated content
HookPoint uses third-party AI services to generate identifications, tips, and summaries. AI output can be wrong. Examples we know about:
- Fish identification can be uncertain on similar-looking species (e.g., largemouth vs. spotted bass).
- Habitat and behavior tips are general — local conditions matter more than any model.
- Regulation summaries can lag behind the agency that publishes the official rule.
Treat AI output as an informed starting point, not an answer key.
8. Safety
Fishing and being near water carry inherent risks. HookPoint is not a navigation aid, weather alerting service, or safety-critical system. Always check NOAA marine forecasts and local conditions before going on or near the water. You are responsible for your own safety and the safety of anyone fishing with you.
9. Intellectual property
HookPoint, its design, code, copy, illustrations, and brand are owned by Votique LLC. We grant you a personal, non-transferable, revocable license to use the Service in compliance with these Terms. Your photos and notes remain yours.
10. Privacy
Use of the Service is also governed by the Privacy Policy, which is incorporated into these Terms by reference.
11. Termination
You can stop using HookPoint at any time by uninstalling the app. We may suspend or terminate access if you violate these Terms or applicable law. Sections that should survive termination — including disclaimers, limitations of liability, and dispute resolution — survive.
12. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL VOTIQUE LLC OR ITS OWNERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR US$50, WHICHEVER IS GREATER.
Some states don’t allow limits on certain warranties or damages, so parts of this section may not apply to you.
14. Indemnification
You agree to defend and indemnify Votique LLC against any claim arising from your misuse of the Service or your violation of these Terms or applicable law, including a violation of state or federal wildlife regulations.
15. Governing law & venue
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Disputes that cannot be resolved informally will be brought in the state or federal courts located in Pulaski County, Arkansas, and you consent to that jurisdiction.
16. Apple’s standard EULA
Apple’s standard End-User License Agreement applies to the iOS app on a device-licensee basis. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula. To the extent Apple’s EULA conflicts with these Terms, these Terms control between you and HookPoint, but Apple’s EULA continues to govern your relationship with Apple.
17. Changes
We may update these Terms. The new effective date appears at the top, and material changes will be announced in app release notes. Continued use of the Service after the effective date constitutes acceptance.
